    There is a web site, forget the URL (found it using the word 
"copyright" in a Yahoo/Lycos search) that lists informaiton on coyrights.

  it may be if the book has not been reprinted/updated/renewed since the 
1940's that the copyright has expired.

   Realistically, this is the sort of problem that crops up wiht older 
software too.  if the company that created the software no longer exists, 
and no one else has laid claim to the copyright, what good is a 
copyright?  I'd say in this particualr case no one is going to complain.
