Let me PLEASE clarify some info about trademarks for you. Now of course I
disclaim that this does NOT constitute legal advice, blah, blah, blah...
Trademarks need to be federally registered to enjoy FULL & COMPLETE
protection and benefit from additional provision per the federal statute.
When it is registered as such & approved you can then place the "R" inside
the circle next to your trademark accordingly indicating regiistration. If
it has NOT been federally registered then you have waht is known as a
"common law" trademark with much less protection, etc. that is when you
use the (TM).  You can also register trademarks in each individual state.
I can't get into a lengthy explanation of all the requirements &
considerations in deciding the validity of a trademark, its protection and
any dispute between two trademark owners, but there are *plenty* of web
