Just to be as clear as possible here, Tom is discussing the *taking* of
a photograph, while I was discussing the *use* of that photograph. While
it is true that you can shoot to your heart's content in a public place,
it is also true that you are legally constrained in how you use those
images.
Incidently, strictly speaking, you do not need a release to take a
photograph on private property, you simply need permission (verbal's
usually fine). A release typically deals with issues of use and
compensation for that use.
As always, I am passing along my personal experiences and not dispensing
legal advice. YMMV...
