3D-CD
Seems like Dan has initiated one of the HOTTEST TOPICS in a long
time on Photo3D. Kudos for a great topic!!!

Regarding the 3D-CD and how to download your website: You can use a
program called "IN CONTEXT". In Context allows you to download your website
to your hard drive complete with working links and images. Once downloaded
you should be able to save it to a CD-ROM. The only problem I see is
getting it to Dan in that format. For example, my website takes up over 10
megs of space and it would be impossible to put that on floppys.

The problem here could be unauthorized duplication of copyrighted
images on people's webpage. I will explore this more in depth later in this
email. There are those who have official pages and those who have "fair
use" permission to promote images that is copyrighted by the original
owners. The producer of such a CD might be setting themselves up for
possible copyright infringement. There are many copyright owners watching
what government is going to do to regulate the Internet. This is one of the
top issues.
I am concerned about the copyright hurdle that would be encountered
by producing a 3D-CD. For example, when View-Master=AE was purchased by
Fisher-Price Inc., notice was given to some of those who posted any
View-Master=AE material on the Internet to include the proper identification
of their copyrighted logo and name. If you notice the =AE is always placed
after View-Master=AE. To this day, most sites do not include the proper
identification. There is one View-Master=AE logo that is absolutely not to=
be
used online due to a copyright issue. I would think if this logo happened
to be (even innocently) scanned and placed online, then permission was given
by the author to add the pages to the 3D-CD that the real copyright owners
of the logo at Fisher-Price Inc. would protect their rights.
I received several requests from other people to use material
(including animated gifs that I created) wanting to post it on their pages.
I had to decline due to possible problems with letting other people use
images of copyrighted or TRADEMARKED material. =20
When I coordinated the custom production of the Branson, Missouri
View-Master=AE 3-reel blister packet it took months and months of repeated
contact with entertainers, theaters and attractions to obtain the releases
needed to produce the reels. Even after I had obtained some releases, there
were those who pulled out of the project at the last minute due to various
reasons. (One of the nationally known entertainers left Branson to tour and
decided they should not appear on the reels even though they had been part
of the tourist attraction town for years. Another entertainer wanted to be
on the reels and 3D photos were taken, but her manager decided to nix the
final okay only weeks prior to the final pictures being submitted.)
Anyone remember the big name software sponsored computer art contest
a few years ago? The winner told them the art supplied was original. It
turned out part of it was manipulated from already existing material. Big
time lawsuits started flying to protect the original art.
I know the Internet is a new and unique information source. Even
Congress doesn't know how to police it but care should be taken by anyone
participating in such a project.
One possible suggestion would be to approach the 3D-CD as a "review"
CD-Rom. The sites featured on the CD-Rom would be reviewed as if they were
featured in an Internet magazine describing top sites online. The other
option might be a "Guidebook" CD-Rom. If could be approached as a news or
information CD "publication". You should check out the "fair use" clause of
the copyright laws.
I would be happy to contribute some original 3D photographs to such
a project. There were some alternate 3D images I own that didn't make it to
the Branson, Missouri View-Master=AE set that are very interesting.
Having said all that, I would love to see such a CD produced if it was at
all possible.
Now, a few questions to throw out to some Photo3d subscribers:
I never heard if Lincoln Kamm ever got his 3-D CD-Rom produced?
Does anyone have a copy of the CD-ROM that featured high quality anaglyphs
taken from early stereocards. I have the name of the company somewhere on a
downloaded sample image of Mark Twain but I can't think of their name right
now. This was about five or six years ago and I don't know how long before
that the company existed. I tried to order one but the letter came back as
undeliverable. I think the company listed an address in Cincinnati, Ohio.
Mary Ann and Wolfgang Sell, what do you think the chances are to get
permission from View-Master=AE to use their name on the CD-Rom using various
unofficial websites featuring scanned images of their product, literature
and logos?
