Yes, it would be the scanner... or if your prints are the rough type
as oppsed to the smooth shiny type, then it's possible that the scanner
picked this up and produced a "moire" pattern which you also get when
scanning magazines due to the spots in the picture.

BTW: does it really really matter if the negs are cut?
