Dan Asks whether the presence of a "party pooper" (okay, I admit it: my term,
not Dan's) would "affect anyone's desire to be a part of the 3D-CD project in
a
 negative way."  

I say it would be a real loss if that person's claim to "rights" to what he
has already written in a quasi-public forum, with no prior claim of
intellectual property right or ownership should cause the P3d digests to be
dropped from the project.  

I also seriously question whether that person has any cognizable right to his
or her  pearls of wisdom, especially since the CD Dan has so generously
offered to assemble would go only to a subset of the very same limited crowd
that already participates in this P3d community, all of whom have already had
access and continue to have access to those very same pearls of wisdom.

If it would make that unnamed person feel any better, perhaps the CD could be
accompanied by a stern copyright notice stating that the complete rights to
each image or written passage on the CD is retained by the originator of that
image or written passage, and that no part of the CD is to be reporduced in
any form whatsoever without explict written permission from such originator.
If that person's uneasiness is not persuaded by such a notice, I feel truly
sorry for him or her.  I'd be tempted to go ahead with the project anyway, and
let whoever it is sue, knowing that his or her transactional costs would far
exceed the damages that could be extracted from a totally not-for-profit
enterprise where the measure of damages is incalulably small.

In any case, even if that person's pearls of wisdom are absent, and even if
that means we have to forego the entire P3d content, I'd still like very much
to have a copy of the fruits of  Dan's efforts.   Jim Norman
